An Outrageous case of Discrimination

A 19-year-old Clovis man and his 36-year-old mother are scheduled to be in court this morning to face charges of incest.

Why? They’re both legally adults and should be able to have a relationship with whoever they please.

Caleb Peterson and his mother, Monica Mares, could each face up to three years in prison and a $5,000 fine if convicted.

Look at these possible sentences… for SEX BETWEEN CONSENTING ADULTS. This is outrageous and ridiculous.

District Attorney Andrea Reeb said the Clovis-Portales prosecutor’s office has had about 10 cases of incest since 2000, but none have involved two consenting adults. Five cases  involved adults with juveniles and the others resulted in dismissals or convictions on lesser charges.

This is the problem here, the word ‘incest’ is used in law to refer to sexual activities between ANY two relatives, it doesn’t distinguish between relatives who prey on related children (which is pedophilia and SHOULD be punished), and adult relatives who fall in love and have a sexual relationship. Now, I think that any reasonable minded person would take a look at this fact and realize that there is an injustice here. This is why so many people use the word ‘consanguinamory’ to describe consenting adult incest, and use ‘pedophilia’ to describe adult predation of minors whether those minors are related or not.

A criminal complaint filed Feb. 25 shows police responded to a public affray near the suspects’ home on Edwards Street.

During the investigation of that domestic dispute, police learned of allegations that Peterson and Mares were having sexual relations.

In other words, their neighbors shopped them, probably to distract the cops from the reasons they were in the area in the first place, or just out of spite, or even a misguided sense of ‘right and wrong’. In any case, it’s SAD.

“Caleb admitted to having a sexual relationship with Monica whom he knows to be his biological mother,” the criminal complaint reads.

Mares denied having sexual relations with her son, the court record shows.

Advice to anyone who gets questioned or arrested by police on incest charges: Blanket denial or ‘No Comment’

You can’t be convicted without evidence, and if there is none they will have to let you go.

The relationship turned romantic and sexual in nature after Peterson moved in with his mother, sometime after his 18th birthday, the record shows.

Yes, they were ADULTS… we get it, and the prosecutors are assholes for even pursuing this.

“I can’t put my personal views into it,” she said. “If they violated the statute, even if it’s consensual, it’s the law and we will prosecute it.

“If the facts are weak, I might use discretion … I just can’t get all the information to make that decision at this early stage in the proceeding.”

WHY should consenting adults be treated like criminals? I for one can think of no good reason to waste public money prosecuting consensual adult incest. This is the true face of discrimination… it’s ugly and it is WRONG. I stand strongly against these cases of persecution because there is no need for it. What were this loving couple doing to hurt anyone? Absolutely nothing, and so they should be left alone to live life in peace. Cases like this are horrifying to me, it shows how badly reform is needed.
